Temporary Employment – What Is It and How Legal Is It?

Temporary employment, also known as staff leasing or labor hire, is a specific way of organizing work under an employment contract. Only two types of fixed-term employment contracts can be concluded in such cases: for the completion of a specific task and for substituting an absent employee. Another key requirement is that only employers registered with the Employment Agency as temporary work agencies are allowed to offer such contracts. These employers must meet additional criteria, hold a specific type of insurance, and submit various documents—including the employment contracts themselves—for prior approval by the Employment Agency.

Another important aspect of temporary employment is that the employees do not work for the employer with whom they sign the contract. Instead, they are assigned to work temporarily at another company—effectively, as if working for another employer. Don’t worry—you won’t be sent to just anyone. The employer who signs your contract and the company where you will be sent must have a detailed written agreement outlining the exact terms and conditions. This agreement is also subject to review and approval by the Employment Agency.

All of this is designed to ensure and protect the rights of workers employed under temporary arrangements, and to maintain clarity and transparency in the process.

To summarize briefly: under a temporary employment arrangement, you are hired by one employer in order to be sent to work for another. You will know exactly what position you are taking, what your rights and obligations are, and all other essential details at the time of signing your employment contract. You will receive your salary and social security contributions just like with any other regular employment contract. You will be entitled to paid leave and all other rights provided by law.
Why do companies use temporary employment? The reasons may vary. For example, a company might be experiencing a temporary increase in workload or may need to complete a specific task that cannot be handled by their permanent staff due to lack of expertise or current workload.
